Please read these terms, conditions, and policies very carefully. Any additional or different terms or conditions in any form delivered by you ("Customer") are hereby deemed to be material alterations and notice of objection to them and rejection of them is hereby given.
PUBLIC WEB SITE
By accessing the MedTutor.com public web site, you agree to be bound by these public web site terms of use. MedTutor.com reserves the right to change these terms anytime. No portion of any of the information provided on the web site may be reproduced in any form whatsoever without the prior written consent of MedTutor.com. You may view, print, and reproduce information from the site provided the use is solely for non-commercial purposes and provided that no information obtained from the site is modified or altered in any way. Any information provided on the site is provided 'as is' without warranty of any kind. MedTutor.com assumes no responsibility for errors or omissions in the information on the site. The site contains links to third-party web sites which are not under the control of MedTutor.com, and MedTutor.com makes no representations about any other web site to which you may have access through the site. The MedTutor.com names are registered trademarks of MedTutor.com. All other trademarks, trade names, or company names referenced herein are used for identification only and are the property of their respective owners. GENERAL RETURNS, REFUND, AND EXCHANGE POLICY
You may return new and unopened items sold by MedTutor.com.com within 30 days of delivery for a full refund. All items require prior authorization from MedTutor.com before they can be returned. We will also pay the return shipping costs if the return is a result of our error (e.g. you received an incorrect or defective item, etc.). Items being returned due to a customer error in ordering or handling will be subject to a restocking fee and freight charge. You should expect to receive your refund upon receipt of the product in our distribution center; however, in many cases you will receive a refund more quickly. This time period includes the transit time for us to receive your return from the shipper (5 to 10 business days), the time it takes us to process your return once we've received it (3 to 5 business days), and the time it takes your bank to process our refund request (5 to 10 business days). We will notify you via email of your refund once we've received and processed the returned item.
MedTutor.com DOES NOT accept returns on (i) items from orders older than 30 days, (ii) MedTutor.com web service subscriptions, (iii) items that have obvious signs of use, and (iv) any item not returned in the condition it was received. If you received a faulty item and need to exchange it for the same item, contact MedTutor.com Customer Service who will call or email you with authorization. If you would like to exchange an item for a different one, please return the original item and you will be refunded your original purchase price once we receive the item. Then place another order for the item you wish to purchase or contact Customer Service to have them place the new order. The returned product must be in good and sellable condition.
MEDTUTOR WEB SERVICES
Clicking the "I Accept. Create My Account" button during registration is your electronic acknowledgment that you accept and agree to be bound by the terms, conditions, and polices stated herein.
(a) In consideration of Customer's use of the Service, Customer agrees to provide true, accurate, current and complete registration information, and to maintain and promptly update such information to keep it true, accurate, current and complete. Customer certifies that Customer is at least 18 years of age. Customers' registration information and personally identifiable data are subject to the MedTutor.com Privacy Policy contained herein.
(b) Customer's Account is to be used solely by the person for whom it was created. Use of an Account by more than one person violates this Agreement and remedies set forth in this Agreement shall apply. Each Customer is responsible for maintaining the confidentiality of his or her password and Account. Customer agrees to notify MedTutor.com of any unauthorized use of his/her Account or any breach of security. MedTutor.com will not be liable for any loss that a Customer may incur, or may create, as a result of someone else's usage of his or her password or Account, either with or without Customer's knowledge or assent. Customer may not use any other Customer's Account at any time for any reason. Any access by Customer to another's Account, or directly or indirectly permitting another to access Customer's Account, by means of impersonation or otherwise will result in the application of remedies described herein.
(c) Customer agrees not to knowingly use the Service for any purpose that is unlawful or prohibited and not to knowingly use the Service in any manner which could damage, disable, overburden, or impair the Service or network(s), communications equipment or computer(s) connected to the Service, or interfere with any other party's use and enjoyment of the Service. Customer shall not knowingly attempt to gain unauthorized access to the Service, other Accounts, computer systems or networks connected to the Service, through hacking, password mining or any other means, nor shall Customer knowingly commit an act or omission that facilitates such activity by another person. Customer agrees not to knowingly disable or bypass any functionality of the Service. Customer will not knowingly, nor shall Customer commit an act or omission that knowingly assists another person's effort to harvest or otherwise collect information about others, including but not limited to Customer e-mail addresses for spamming or other purposes.
(d) In the event that MedTutor.com is required to discontinue offering the Service, or chooses to discontinue the Service, Customer acknowledges and agrees that MedTutor.com has no further obligation to Customer under any circumstances.
(e) Customer acknowledges and agrees that the Service and any necessary software used in connection with the Service contain proprietary and confidential information that is protected by intellectual property and other applicable laws. MedTutor.com grants Customer a limited, personal, non-transferable, non-exclusive license, in object code only, to use the MedTutor.com enterprise software, API, and API-generated or derived utilities, documentation or any other MedTutor.com software. Customer agrees not to, for the benefit of Customer or a third party, modify, copy, distribute, transmit, display, perform, reproduce, publish, license, reverse engineer, create derivative works from, build a product using ideas, functions, or graphics similar to, transfer, or sell any information, software, products or services obtained from MedTutor.com or the Service.
(f) This Agreement is subject to change from time to time. In addition, MedTutor.com has the right to change or update any information or content available through the System without notice at any time.
(g) Customer understands and agrees that MedTutor.com will monitor your usage and any information or content transmitted by you through the System in order to: (i) comply with any applicable laws, rules, or regulations or other governmental orders; (ii) administer the System; and (iii) protect MedTutor.com, it's clients, the Customer, and other Customers of the System.
(h) Customer agrees to use every reasonable effort to keep confidential all information contained with the System. Moreover, you agree to use the information contained within the system solely for the purposes of self study. You agree not to disclosure, publicize, or dissemination any information within the System without the prior written consent of the MedTutor.com. By using the System you do not acquire any ownership rights to any content within the System. All information contained in the System shall remain the exclusive property of MedTutor.com.
(i) You have been assigned a Customer user name and password for accessing the System. You are responsible for maintaining the confidentiality and security of your Customer user name and password, and you are fully responsible for all conduct carried out under your Customer user name and password.
PRIVACY POLICY
No information that can uniquely identify an individual is gathered by merely visiting the public web site. Personally identifiable information is only collected when you purchase products and are registered for a MedTutor.com Service. This information includes: Name, Address, Email, Phone, Organization, and Payment Information. (Note: payment information is collected using SSL encryption and is only required when services are purchased. Credit card information is not stored online).
MedTutor.com will not sell or rent your personally identifiable information to anyone. We may share personally identifiable information about you to other companies or people when (i) verification services are required to process payments, or (ii) your actions violate the terms of use or the law.
If you have not opted-out of receiving mailings, we will communicate (generally email, website, or Help documentation) with you to update MedTutor.com Service information, provide support, request feedback, provide marketing and service information, request marketing input, and provide special offers and incentives related to MedTutor.com. We may post feedback comments from Customers as anonymous comments on our Web page. Non-identifiable, aggregate information may be shared with interested parties. If you have opted-out of receiving these mailings, your only avenue of information regarding the service will be via the website or within the service.
You have the opportunity to opt-in to these mailings. You also have the ability to opt-out at a later time by adjusting your Account Information in the service. When you contact us via links on our site, your email address and information is kept only for the purposes of responding to your request and future requests that you may have. If you contact us via support, any information you provide may be used to respond and resolve your questions or issues.
The MEDTUTOR PRE-MED PREP PACK GUARANTEE
The terms and conditions of the MedTutor Pre-Med Prep Pack Guarantee are as follows:
- Go to www.MedTutor.com and purchase the special Pre-Med Prep Pack. Study the materials for as long as you desire.
- When prepared, take and pass each of the 4 web-based final exams (medical combining forms, medical terminology, peripheral nervous system [includes general anatomy], cranial nerves).
- Spend at least 3 hours per week for 4 consecutive months actively working on the interactive learning applications of www.MedTutor.com.
- With acceptance to medical or dental school and completion of the above criteria, MedTutor guarantees that you will pass your first year of medical/dental school or receive a full refund; refund is limited to instances in which promotion to the second year of school is witheld due to academic underachievement. Does not include student withdrawal for health-related, disciplinary, or personal reasons.

THE SITE, WEB SERVICES, AND ALL INFORMATION, CONTENT, MATERIALS, BOOKS, POSTERS, PRODUCTS (INCLUDING SOFTWARE) AND SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE SITE ARE PROVIDED BY MEDTUTOR.COM ON AN "AS IS" AND "AS AVAILABLE" BASIS, UNLESS OTHERWISE SPECIFIED IN WRITING. MEDTUTOR.COM MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESSED OR IMPLIED, AS TO THE OPERATION OF THIS SITE OR THE INFORMATION, CONTENT, MATERIALS, BOOKS, POSTERS, PRODUCTS (INCLUDING SOFTWARE) OR SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THIS SITE, UNLESS OTHERWISE SPECIFIED IN WRITING. APPLICABLE LAW
By visiting MedTutor.com, you agree that the laws of the state of MIssissippi, without regard to principles of conflict of laws, will govern these terms, conditions, & policies and any dispute of any sort that might arise between you and MedTutor.com. If any provision of this Agreement shall be deemed invalid, the validity of the remaining provisions of this Agreement shall not be affected. Customer agrees that regardless of any statute or law to the contrary, any claim of action arising out of or related to MedTutor.com must be filed within one year after such claim or cause of action arose or be forever barred.
